EU classification and import conclusion

Conditional conclusion: an articulated arm containing its axes, actuators, drives, transmissions and wrist, and therefore the essential character and individual function of a multipurpose industrial robot, is a candidate for CN 8479 50 00 even if the controller or gripper is not in the same package. A skeletal or replacement assembly lacking the core elements that give the robot its character requires analysis under 8479 90 or the heading of the component itself. A configuration dedicated to welding, lifting, spraying, semiconductor manufacture or machining follows the specific function.

Three conditions at import

Distinguish: a substantially complete driven arm awaiting external control; a mechanical subassembly of castings, links or empty joints; and an arm entered with controller, tooling and equipment forming a specific system. GIR 2(a) may treat an incomplete or unassembled article as complete only when essential character exists. Section XVI Note 4 applies to a functional unit only where the components together perform one clearly defined function. Customs examines the entered presentation and coordinated consignments, not merely the intended post-import label.

When CN 8479 50 00 applies

Apply GIR 1 and 6 and Section XVI notes. Evidence for 8479 50 includes multiple controlled axes, installed servo motors and reducers, a reprogrammable interface, interchangeable wrist tooling and ability to perform different tasks. Absence of an end-effector does not automatically turn the arm into a part. Submit BOM, exploded view, drive diagram, controller interface, compatible tooling and software description. The residual industrial-robot code is available only after excluding more specific functional headings.

Parts and Section XVI Note 2

A true part is identifiable for sole or principal use with heading 8479 machinery but lacks the arm’s essential character. Section XVI Note 2 comes first: motors, gearboxes, bearings, cables, sensors and electrical apparatus described by another heading remain there when separately imported. Empty links, joint housings and replacement wrist assemblies may fall within the appropriate 8479 90 code. An almost complete arm is not a part merely because an external control cabinet is absent.

Controller and tooling

A separately presented control cabinet generally requires heading 8537 analysis. Grippers, weld guns, spray heads, spindles, vision systems, positioners and safety controllers also need their own classification. If the imported combination performs only welding, handling or spraying, compare headings 8515, 8428 or 8424. A functional-unit claim cannot place a specific-function system in residual heading 8479.

Duty and import VAT

CN 8479 50 00 normally carries 0% conventional third-country duty. The exact 8479 90 and 8537 code, origin and TARIC measures must be checked because rates and trade remedies can differ. Import VAT follows the Member State; preference requires qualifying origin and proof. Customs value can include tools, assists, engineering, software and royalties. A zero machine rate never removes the need to classify separately invoiced controllers or components correctly.

Machinery law and CE

Until 19 January 2027, Directive 2006/42/EC generally governs placing on the market; Regulation (EU) 2023/1230 applies from 20 January 2027. Decide whether the arm is machinery or partly completed machinery. A bare arm intended for integration often needs a declaration of incorporation and assembly instructions, while the integrator becomes responsible for risk assessment, technical file, EU declaration and CE marking of the completed cell. EMC, LVD, RED, RoHS and WEEE may also apply.

Customs file and description

Keep invoice, transport and origin records, valuation, BOM, exploded drawings, installed motors/reducers, axes, payload, reach, controller interface, software, tool list, crate photographs and conformity documents. Suggested description: “Six-axis articulated industrial robot arm with installed servo motors and joint drives, reprogrammable and suitable for interchangeable end effectors, payload ... kg, model ..., without controller or gripper, new, origin ..., CN candidate 8479 50 00.” State every missing component.
