Classification and duty conclusion
A complete household electric convection oven with an enclosed chamber, resistance heating elements and a fan circulating hot air is generally classified in CN 8516 60 90 and TARIC 8516609000. The standard third-country customs duty is 2.7%, subject to TARIC measures on the declaration date. Import VAT is charged at the Member State rate. The conclusion excludes enclosed ovens, dedicated toasters, commercial fixed grills, gas appliances and separately imported parts.
CN and TARIC boundary
GRI 1 and 6 require evidence of enclosed chamber, heating elements, convection fan, thermostat, timer, voltage, power, dimensions, weight and household use. The marketing expression “air fryer oven” is not decisive. A microwave-combination oven, basket air fryer, toaster or multifunction appliance may follow another CN subdivision according to its objective design and principal function.
Duty, origin and VAT
EVFTA preference requires genuine preferential origin, the product-specific rule, non-alteration and valid proof; shipment from Vietnam alone is insufficient. VAT is calculated on customs value, duty and statutory additions. Anti-dumping, safeguard or origin-related measures must be checked in TARIC by code, origin and date before entry.
CE and product safety
Before placing the product on the EU market, the importer must address Directives 2014/35/EU and 2014/30/EU, RoHS and GPSR 2023/988. EN IEC 60335-1 and EN IEC 60335-2-9 are the central safety references for grills and similar portable cooking appliances. The file should cover hot surfaces, door-glass temperature and strength, blocked-fan overheating, abnormal operation, stability, cord, insulation and thermal protection, followed by the EU declaration, CE marking, traceability and local-language instructions. Radio functions add RED.
Food-contact and environmental duties
Racks, trays, coatings and interior surfaces require food-contact documentation under Regulation 1935/2004 and, for plastics where applicable, Regulation 10/2011. Composition, migration and intended temperature must match the shipped model. WEEE registration, RoHS technical evidence and packaging EPR are separate national obligations; standby/off-mode ecodesign rules should be checked for electronically controlled models.
Importer file
Retain invoice, transport, valuation and origin proof; specifications, photographs and manual; BOM, circuit, heaters, thermostat and safety parts; LVD/EMC tests, RoHS and food-contact declarations, migration reports, risk assessment, EU declaration, labels and responsible economic-operator details. Suggested description: “Household electric convection oven, enclosed chamber with resistance heaters and forced-air fan, ... V, ... W, model ..., new.”
When to reassess
Reassess a microwave-combination oven, basket air fryer, toaster, built-in range, stationary professional machine, gas appliance, multifunction appliance, unassembled set or separate plate, heating element, controller, tray or housing. Customs classification, CE, food contact, WEEE, radio and packaging remain independent compliance layers.
