A classification opinion — even a good one — is still an opinion. A binding ruling converts it into a legal right. Here is how the four biggest systems work.
United States: CBP eRulings (19 CFR Part 177) Any importer, exporter or their agent may request a ruling electronically. CBP aims to answer classification requests within 30 days. Rulings are published in CROSS and bind CBP nationwide for identical goods. Cost: free. Strategy: search CROSS first — if a ruling on a like product exists, you may simply align with it.
European Union: BTI via the EU Trader Portal Binding Tariff Information is valid 3 years and binds every member state's customs AND the holder. Since the UCC, you must hold an EORI and declare goods under the BTI reference. Processing may take up to 120 days when samples or lab analysis are needed.
Vietnam: xác định trước mã số File the dossier with the General Department of Customs at least 60 days before the first shipment (Decree 08/2015/ND-CP, amended by 59/2018). Provide technical documentation and samples where possible. The written determination applies nationwide, generally up to 3 years while the goods and legal basis remain unchanged.
China: GACC advance rulings (Decree 236) Registered enterprises apply to their customs district; decisions are issued in principle within 60 days and are valid 3 years. Combined with China's "declaration elements", a ruling dramatically reduces port disputes.
When a ruling is worth it - New product lines with significant volume or value - Duty-rate gaps between candidate codes (including anti-dumping exposure) - Borderline goods: multifunction machines, sets, chemical preparations, "smart" devices - FTA planning where the PSR depends on the classification of inputs
